Dear Mr. Passarella:
On behalf of my client, Citizens Against UFO Secrecy, Inc. (CAUS), I hereby submit this request under the provisions of the Freedom of Information Act (FOIA), 5 U.S.C. §552.
This request is for any and all of the below referenced documents relating to Citizens Against UFO Secrecy, Inc. v. Department of Defense, CIV-99-0108-PHX-SMM (Ref: 98-F-1958):
1. Pursuant to the declaration of Richard L. Dunn dated July 12, 1999:
a. all responses from DARPA employees and "contract support personnel" to the electronic mail message marked "high importance."
2. Pursuant to the declaration of Edmund F. McBride dated March 10, 2000:
a. all responses generated by the use of the keywords stated in said declaration.
b. the method and search techniques used in the computer generated search..
3. Pursuant to the declaration of Edmund F. McBride dated July 12, 1999:
a. any and all information pertaining to the purpose and mission statement of the Defense and Space Operations Division, Operations Directorate (J-3);
b. the method and search techniques used within the Defense and Space Operations Division.
4. The complete case file relating to Ref: 98-F-1958
The FOIA requires that an agency, "upon any request for records made under paragraph (1), (2), or (3) of this subsection, shall - (i) determine within ten days (excepting Saturdays, Sundays and legal public holidays) after the receipt of any such request whether to comply with such request and shall immediately notify the person making such request of such determination and the reasons therefor ."
